A surcharge of $15.00 per kayak applies to public holidays Children age is from 10 – 15 years old and must be accompanied with an adult kayaker in a double kayak. Children must be able to paddle throughout the tour Participants must have reasonable fitness levels. Dolphin Sanctuary Kayak Tours will take no responsibility for gift vouchers that are lost or stolen. All gift vouchers must be used prior to their expiry date. NO extensions will be given, unless prior arrangements have been made. Please note our tours are weather dependent and can be cancelled at any time, if we deem the weather to be unsuitable. When participating in a kayaking tour, a waiver of liability will need to be signed. Participants under the age of 18 years will also need a signature from a responsible person (18 years and older) – this link will be sent to you in an email or sms message form. Acknowledgement of Risk: I acknowledge my permission to participate in Dolphin Sanctuary Kayak Tours activities. I acknowledge that these activities may have inherent risks involved and I voluntarily acknowledge and understand that serious accidents can happen and I assume responsibility for myself/ my child participating in these activities. I acknowledge that during all such times whilst myself / my child is participating in the activities I agree to release Dolphin Sanctuary Kayak Tours and its respective officers, employees, agents and contractors, from all actions, demands, claims for cost, charges, damages, liabilities and expenses, which I have now or in the future against Dolphin Sanctuary Kayak Tours for death, bodily injury or any loss or damage that the participant may sustain or incur as a result of participating in the activity. The participant also agrees to indemnify and hold harmless Dolphin Sanctuary Kayak Tours in relation to any claims as a result of, or arising in relation to, whether directly or indirectly, participating in the activity or any act or omission by the participant in relation to the activity. I will not hold Dolphin Sanctuary Kayak Tours liable for any personal injury or loss of property whatsoever and I agree to indemnify and keep indemnified Dolphin Sanctuary Kayak Tours against all such injury or loss except to the extent that such personal injury or loss of property is occasioned by neglect, default or omission by Dolphin Sanctuary Kayak Tours or their consultants, employees, contractors or agents (as the case maybe). I agree that I will pay any reasonable cost of repair or replacement to equipment or facilities that may be damaged by actions of myself/ my child beyond that of normal wear and tear. (If minor) I agree to instruct my child to follow the rules of the activity participation and to follow instructions given for Dolphin Sanctuary Kayak Tours. I agree that I will: • Follow the safety instructions provided by the guides and will ask them about any information which I do not understand; • I will take good care of the equipment supplied and return in the same condition as supplied. • I will inform Dolphin Sanctuary Kayak Tours of any medical or physical conditions that would affect your participation in the activity; • I will not consume alcohol or other drugs before or during the activity; • Dolphin Sanctuary Kayak Tours may arrange evacuation and medical or hospital treatment as necessary and you agree to pay for all associated costs; • If you are hiring kayaks and going out unaccompanied you have 3 hours use of the equipment beginning at the time indicated on your booking. You agree to return the equipment in the specified time frame. Late return will be charged at $20 every 30 minutes overdue. Pre/Post Tour On the day of your tour Dolphin Sanctuary Kayak Tours may ask you to assist carrying kayaks to storage. If you are unable to do this, please ensure you advise your guide. Cancellation Policy Public Tours If cancellations are made less than 24 hrs prior to scheduled departure date or participants fail to show, we are unable to provide a refund or reschedule. Private Tours Cancellations made less than 1-month prior will forfeit 50% of the tour cost, and we are unable to reschedule. If cancellations are made less than 7 days prior to scheduled departure date or participants fail to show—the full tour amount will be charged, and we are unable to reschedule Minimum Numbers Dolphin Sanctuary Kayak Tours reserve the right to cancel any session if the minimum number of participants has not been met. Weather Policy Our experiences operate in all types of weather conditions. Should the weather be deemed unsafe to operate, our office will contact you as soon as possible to reschedule your booking. There may be instances when the weather may be different to the forecast which can result in the tour needing to be cancelled at the beginning of your session. We actively try to avoid this, however strong gusts of wind or unexpected rain bands can be unpredictable.
