This agreement is made between A + K Investments and the hirer listed above, whereby it is hereby agreed that the Hirer will hire from A + K Investments , under the terms and conditions of this agreement, the bicycle/s described in the Schedule of Hire. *RISK WARNING* RECREATIONAL ACTIVITIES INCLUDING BIKE RIDING INVOLVE A SIGNIFICANT RISK OF PHYSICAL HARM OR PERSONAL INJURY INCLUDING PERMANENT DISABILITY AND/OR DEATH TO PARTICIPANTS. GENERAL TERMS AND CONDITIONS OF BIKE HIRE Please read carefully the following terms and conditions. In completing Booking Form, you agree to be bound by these conditions that form the agreement 1] Payment Prices quoted on the website are in Australian dollars and are payable by credit card. 2 ] Cancellations/refunds/transfers If you wish to cancel your booking, you must notify cancellation will take effect subject to the following: If your notice is received inside 48 hours of your booked date, 100% of your paid price will be refunded or credited. If cancellation occurs outside 48 hours prior to your booked date, you have a choice of one of the two following options: Option 1: You may request a credit for the amount paid, whereby your order is put on Hold. You can use this for another date for any nominated persons subject to availability. OR Option 2: You may receive a refund with a 20% administration cancellation charge. 3] A + K Investments assumes each rider has completed a signed waiver as instructed before participation in any mountain bike activity with the company. 4 ] Travel insurance It is a condition of booking with A + K Investments that you are adequately insured in respect of illness, injury, death, damage or loss of personal items. It is your responsibility to make such insurance arrangements. 5] Reasons out of our control If A + K Investments is prevented (directly or indirectly) from performing any of its obligations under this agreement by reason of act of God, strikes, trade disputes, fire, breakdowns, interruption of transport, government or political action, acts of terrorism, acts or omissions of a third party or any other cause whatsoever out A + K Investments reasonable control, A + K Investments will be under no liability to you and may, at its option, by written notice, either cancel or arrange alternative arrangements. 6) No refunds for early return. 7 ] Assumption of Risk and safety declaration You acknowledge that: • By its very nature mountain bike adventure travel can be more challenging and demanding with a commensurately high level of risk, and involve potential exposure to injury and possibly death, and: • You are solely responsible for your riding and own judgment to participate within your capabilities and that you are solely responsible for your health and well being. • The additional dangers and risks associated with mountain bike adventure travel may include difficult and dangerous terrain, extremes of weather, including sudden and unexpected changes, remoteness from normal medical services and from communications and evacuation difficulties in the event of illness or injury •A + K Investments reserve the right to withdraw any person who in our opinion is likely to endanger themselves or others or who will not likely complete the trail within the designated time frame. We also reserve the right to cancel any activity if we become concerned for any reason for your safety or that of any other person. • You must follow our instructions and use any safety equipment provided at all times. All personal equipment should meet Australian Standards and be in adequate condition and suitable for riding on mountain bike trails. A + K Investments reserves the right to refuse service to any persons where equipment personally provided is deemed unfit by our team. -For the above reasons you accept the inherent and increased dangers and risks associated with the proposed adventure and the accompanying risk of injury, death or property damage or loss. BIKE AND HIRE EQUIPMENT Terms and Conditions: 1. Bicycles returned with damage are subject to a repair fee and any replacement parts required. A + K Investments reserves the right to debit the billing details Credit Card with the repair and replacement parts fee. 2. Bicycles not returned will be replaced at current value. A + K Investments reserves the right to debit the billing details Credit Card listed with replacement fee. 3. Equipment returned broken, damaged or not returned will be charged per item for replacement. A + K Investments reserves the right to debit the billing details Credit Card listed with replacement fee. 4. It is the responsibility of the hirer to return all bicycles & all equipment to the designated/ agreed location and time. A + K Investments reserves the right to charge a late fee on each bike hired at a rate of $45 every 30 minutes returned after the agreed time. 5. Bicycles must not be left unattended at any time. 6. Approved AUS standard helmets must be worn at all times while riding. 7. The person hiring agrees and accepts that riding a bicycle is a hazardous activity and can result in death or serious injury. 8. The person hiring agrees that A + K Investments and its employees are released from and indemnified against any claim for injury, loss or damage to the hirer, or any persons or property which is in any way connected to the participation in the use of the bicycle however caused. The hirer agrees to waive their right to present legal claim or lawsuit against A + K Investments, regardless of negligence or any other manner considered through legal claim. 9. A person under 18 years of age may hire a bicycle only with the written consent of a parent or guardian. Signing this form indicates consent for all riders of hire bikes on the booking and this form. 10. A + K Investments reserves the right to refuse bicycle hire to any person including those that exceed manufactures weight limit.
