By joining Wild Byron Pty Ltd, I acknowledge that I will be participating in outdoor activities that are potentially dangerous, including but not limited to: walking, hiking, swimming, boating, kayaking, biking, and camping events organized by Wild Byron Pty Ltd. Wild Byron Pty Ltd organizes outdoor adventure experiences and guided tours (“Tours”). The waiver of liability is an agreement that attendance on these Tours is strictly voluntary and of my own choice, and I agree 100% to accept personal responsibility for all and any foreseen and unforeseen events that may occur during, including travel to and from, Wild Byron Tours, activities, and non-Wild Byron activities. I understand that during my participation in Wild Byron Tours, I may be exposed to a variety of hazards and risks, foreseen or unforeseen, which are inherent in each Tour and cannot be eliminated without changing the unique character of these experiences. These inherent risks include, but are not limited to, the dangers of serious personal injury, property damage, and death (“Injuries and Damages”) from exposure to the hazards of outdoor activities and travel to and from these activities. Wild Byron Pty Ltd has not tried to contradict or minimise my understanding of these risks. I understand that Injuries and Damages can occur due to natural causes or the actions of other persons, wildlife, fellow participants, guides, or third parties, whether as a result of negligence or other factors. Wild Byron Pty Ltd, its guides, staff, and participants take no responsibility for me and will not be held liable for any injuries or accidents that may occur during Tours. Outdoor adventure activities are inherently dangerous, and accidents can happen; these risks are part of participating in such experiences. I understand that I may have to exercise extra caution for my own safety and that of others around me in these environments. In consideration of my acceptance as a participant on Tours, I confirm my understanding that: • Wild Byron Pty Ltd does not certify or confirm the qualifications of its guides, employees, or participants to lead or manage Tours. I acknowledge that they may not be trained to respond during an emergency with first aid, CPR, or rescue action. I further understand that there may not be search, rescue, or medical facilities available or adequate to deal with Injuries and Damages to which I may be exposed during these activities. • Tours officially begin and end at the location(s) designated by Wild Byron Pty Ltd. Tours do not include carpooling, transportation, or transit to and from the designated meeting points, and I am personally responsible for all risks associated with this travel. This does not apply to transportation provided by Wild Byron Pty Ltd during the Tours. • If I choose to leave a Tour early or not to complete the Tour as planned, I assume all risks associated with my decision and waive all liability against Wild Byron Pty Ltd arising from that decision. Similarly, if a guide concludes the Tour and I choose to continue on my own, I assume all risks associated with my choice and waive all liability against Wild Byron Pty Ltd. I understand that hiking, swimming, and other outdoor activities involve a significant amount of physical exertion. Participants must be in good general health, free from cardiovascular and respiratory disease, and have good exercise tolerance. I am responsible for seeking my physician’s approval before participating in such activities. To the fullest extent allowed by law, I agree to WAIVE, DISCHARGE CLAIMS, AND RELEASE FROM LIABILITY Wild Byron Pty Ltd, its officers, directors, guides, employees, agents, and volunteers from any and all liability related to Injuries and Damages, even if caused by negligence, connected to my participation in these Tours. I further agree to HOLD HARMLESS Wild Byron Pty Ltd, its officers, directors, guides, employees, agents, and volunteers from any claims, damages, injuries, or losses caused by my own negligence while participating in the Tours. I understand and intend that this assumption of risk and release is binding upon my heirs, executors, administrators, and assigns, and includes any minors accompanying me. This Agreement is intended to be as broad and inclusive as permitted by law. If any provision or part of any provision of this Agreement is held to be invalid or legally unenforceable, the remainder of this Agreement shall remain valid and fully enforceable. By joining, I freely and voluntarily assume all risks of Injuries and Damages. BY THIS INSTRUMENT, I AGREE TO EXEMPT AND RELEASE ALL THE ABOVE LISTED (passenger/diver) ENTITIES AND/OR INDIVIDUALS FROM ALL LIABILITY AND RESPONSIBILITY FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH, HOWEVER CAUSED, INCLUDING BUT NOT LIMITED TO, PRODUCT LIABILITY OR THE NEGLIGENCE OF THE RELEASED PARTIES, WHETHER PASSIVE OR ACTIVE. I HAVE FULLY INFORMED MYSELF AND MY HEIRS OF THE CONTENTS OF THIS LIABILITY RELEASE AND ASSUMPTION OF RISK AGREEMENT BY READING IT BEFORE I TICKED IT ON BEHALF OF MYSELF AND MY HEIRS.
