TERMS AND CONDITIONS

88 Luxury Tours Terms and Conditions

Private and Customised Great Ocean Road and 12 Apostles Tour

These terms explain the booking, payment, cancellation and travel arrangements for your private tour. Please read them together with your quotation and booking confirmation before booking.

1 Booking and confirmation

These terms apply to private and customised Great Ocean Road and Twelve Apostles tours operated by 88 Luxury Tours (“we”, “us” or “our”).

Your booking is confirmed when we issue written confirmation and receive the payment required in your quotation. Please check your travel date, passenger numbers, pickup details and itinerary, and advise us promptly of any errors.

The person making the booking must share these terms with all passengers.

2 Prices and payment

Prices are in Australian dollars. Your quotation will specify the total price, applicable GST, inclusions, exclusions and payment deadlines.

The quoted price applies to the agreed itinerary, passenger numbers, vehicle category and tour duration. Requested changes may affect the price. Any additional charges must be agreed before the additional service is provided.

3 Private and customised arrangements

The tour is reserved exclusively for your booked party. Customisation is subject to travel distances, attraction opening hours, availability, safe driving requirements and the agreed tour duration.

Please request any essential stops or special arrangements before booking. Requests are confirmed only when accepted by us in writing.

The Twelve Apostles and other agreed highlights are subject to safe access. Specific weather conditions, wildlife sightings and unrestricted access to natural attractions cannot be guaranteed.

4 Pickup drop off and timing

Pickup and drop-off locations and times will be specified in your confirmation. Please be ready at the agreed pickup time.

We will make reasonable efforts to accommodate delays, but a late start may reduce the time available at attractions. Extensions depend on availability and require agreement on any additional charges.

Return times are estimates and may be affected by traffic, weather or road conditions. Tell us before booking if you have a flight, cruise departure or other time-critical connection so we can assess whether the tour is suitable.

5 Inclusions and optional activities

Only items expressly listed in your quotation or confirmation are included.

Meals, refreshments, admission fees, helicopter flights and other optional activities are payable separately unless expressly included. Optional activities depend on availability and may have additional supplier conditions, which will be provided before purchase.

6 Children accessibility and luggage

All passengers, including infants and children, must be included in the booking.

Please provide children’s ages and any child restraint requirements before confirmation so we can arrange suitable seating and comply with applicable requirements. Children must be supervised by a responsible adult.

Please discuss mobility requirements, wheelchair access, medical needs relevant to participation, prams and luggage before booking. Some stops involve stairs, uneven ground or walking tracks. We will discuss suitable arrangements and alternatives with you.

7 Changes requested by you

Date changes, itinerary amendments and changes to passenger numbers are subject to availability.

We will explain any price difference or reasonable amendment costs before you decide whether to proceed. Reducing passenger numbers does not automatically reduce a private tour’s total price.

8 Cancellations and missed departures

24 hours or more before departure: Cancel for a full refund.

Less than 24 hours before departure: A cancellation fee of up to 100% of the total booking price applies.

No-shows: A cancellation fee of up to 100% of the total booking price applies.

Cancellation charges will not exceed our reasonable costs and losses, taking account of costs saved and any amounts recovered through rebooking. We will take reasonable steps to minimise those losses.

Please submit cancellations in writing. The 24-hour notice period is measured from your confirmed pickup time, using Melbourne local time.

Date changes requested within 24 hours of departure are subject to availability and the same cancellation conditions if the original booking cannot be rescheduled without loss.

This policy applies to customer-requested cancellations. It does not limit your rights under the Australian Consumer Law. Operator cancellations are covered by Section 9.

9 Weather itinerary changes and operator cancellations

Tours generally operate in varying weather conditions when safe.

We may reasonably change the route, order of stops or departure arrangements because of road closures, severe weather, bushfire risk, attraction closures or other safety concerns. We will notify you as soon as reasonably practicable and seek suitable alternatives.

If a proposed change materially alters the tour before departure, we will discuss your options, including an alternative date or refund where applicable.

If we cancel before departure, you may choose an available alternative or a refund of the tour payments received. If an event outside the parties’ control makes performance impossible, refunds and any lawful deductions will be determined under applicable law. You do not have to accept a credit instead of a refund to which you are entitled.

10 Passenger safety and conduct

Passengers must wear seatbelts where fitted, follow reasonable safety instructions and observe signs, barriers and access restrictions.

We may refuse or discontinue participation where a passenger’s conduct presents a serious safety risk or involves threatening, abusive or unlawful behaviour. Any refund will be assessed fairly, having regard to services provided, reasonable costs and applicable law.

11 Vehicles and belongings

We will provide the vehicle category agreed in your confirmation. If a substitution is necessary, we will aim to provide a comparable vehicle. We will discuss remedies with you if the substitution materially reduces the agreed service.

Please keep valuables secure and check the vehicle before leaving. Responsibility for lost or damaged belongings will be determined according to the circumstances and applicable law.

12 Travel insurance

We recommend travel insurance covering cancellation, illness, personal belongings and travel disruption. Please check your insurer’s coverage and exclusions.

13 Australian Consumer Law and complaints

Our services come with guarantees under the Australian Consumer Law that cannot be excluded. Nothing in these terms excludes, restricts or modifies your statutory rights, or our liability where it cannot lawfully be excluded.

Please raise any concern with your driver or guide promptly so we can try to resolve it during the tour. Unresolved concerns can be submitted.

By booking, you acknowledge that you have received these terms and the quotation before accepting the booking.
