TERMS AND CONDITIONS – LAURA THE EXPLORER ADVENTURE TOURS
Laura the Explorer Adventure Tours requests that you read the following Terms and Conditions before booking one of our Tours.
The terms “we”, “us”, and “our” refer to Laura the Explorer, and “you,” “your,” “their,” “they,” and “participant” refer to the customer.
By booking a tour with Laura the Explorer Adventure Tours, you are agreeing to the following terms and conditions:
1. PAYMENT AND DOCUMENTATION
• The Booking Form must be completed accurately, including all medical, dietary requirements, or other information that is relevant for the Tour.
• Any medical information provided will be held privately with your tour guide as per our Privacy Policy.
• You must not embark on a tour if you have any medical condition, mental health condition, injury, illness, contagious disease, or any other condition that would impact your ability to participate in group activities safely, or which would put at risk the safety and well-being of other passengers.
• Confirmation of your booking will be sent once final payment has been made.
2. ITINERARIES AND DESCRIPTIONS
• We reserve the right to change the itinerary and/or substitute any vehicle types, activities, accommodations, or transportation for any reason, including but not limited to safety, weather, or other unforeseen circumstances.
• We cannot guarantee pick-up and drop-off times; however, all efforts are taken to provide the best experience possible for each passenger.
• Participants must provide their own transportation to and from the tour starting and ending points.
• Prices quoted are per person.
• Booking requests are made subject to availability.
• Tour prices and these Terms and Conditions are subject to change at any time at our discretion.
3. TRAVEL INSURANCE
• We highly recommend that you have personal travel and medical insurance that provides you with the best cover for your own personal circumstances.
• Participants are responsible for their own medical insurance and medical expenses.
4. CANCELLATIONS AND REFUNDS
If you cancel:
• Cancellation policy updated for COVID-19: All bookings cancelled prior to one hour of departure will be issued a credit note valid for one year from the date of issue.
• Except for the above point, our normal cancellation policy remains valid.
• All tickets and bookings are non-refundable. Provided that notification is received by Laura the Explorer over 1 hour prior to the scheduled departure date/time, the amount paid for any unused ticket/service can be issued as a credit note for future Laura the Explorer Tours. Notification must be made by phone or email.
• Cancellations must be advised at least 1 hour prior to the tour’s departure date/time.
• Any amendments/changes made within 1 hour of scheduled departure time will result in the forfeiture of all monies.
• Refunds will not be made for inadvertently booking the wrong tour time, departure point, or for personal reasons. Conditions a), b), and c) above still apply.
• Cancellations once the scheduled tour has been undertaken will result in the forfeiture of all monies.
• Credit notes are valid for a period of one (1) year from the date of scheduled travel. No extensions can be offered on credit notes.
• Credit card surcharge and postage and handling fees cannot be refunded or credited.
• Redemption of a credit voucher can only be made when booking via phone or email.
• Unused portions of a credit note will be re-credited. Any unused portion of a credit note will have the same expiry date as the original.
• For any tour cancellations due to adverse weather conditions or mechanical failures that are entirely outside of passengers’ control, passengers will be offered:
1. To transfer to another suitable tour on the same day; or
2. A full refund for any unused components of travel.
• The above cancellation fees are in addition to fees that may be levied by accommodation house properties, travel agents, or third-party tour and transport operator cancellation fees.
• All cancellations or requests to transfer must be made in writing to info@lauratheexplorer.com.au.
• If you fail to join a tour or leave before its completion, you will not receive a refund for unused services.
• If we are forced to cancel, we will offer you the option of:
1. A refund of the cost, or
2. Booking a future tour.
• Our departures will be subject to numbers. If we need to cancel a tour or service, every effort will be made to offer a suitable alternative. If no alternative is available, we will refund the cost.
5. GENERAL TERMS AND RESPONSIBILITY
• We reserve the right to terminate the participation of any participant who does not comply with these Terms and Conditions or who engages in behaviour that is detrimental to the safety or enjoyment of other participants. Our primary consideration is the safety of all passengers, staff, and people we come into contact with during our Tours.
• We are not responsible for any additional expenses incurred by participants as a result of changes to the itinerary or other unforeseen circumstances.
• Participants are responsible for their own personal belongings and equipment, and we are not liable for any lost, stolen, or damaged items.
• Participants must follow all safety instructions provided by the tour operator and its staff and must not engage in any activities that may be dangerous or harmful to themselves or others.
• Participants must respect the local flora and fauna and adhere to all state/federal laws as well as national and local park regulations.
• Every Tour is supported with contingencies in place to provide the best experience possible in any adverse situation. We proudly stand by our strong record of operating a reliable and well-maintained fleet.
• By participating in the tour, participants agree to allow us to use any photographs or videos taken during the tour for marketing and promotional purposes as per our Privacy Policy.
• By participating in a Tour, participants agree to these Terms and Conditions and acknowledge that they have read and understood them.
6. BIKE, HELMET, LOCK, AND SNORKEL HIRE AGREEMENT
The Hirer Shall:
• Pay all charges and expenses levied or made pursuant to the terms and conditions hereof.
• Not allow any other person to operate the equipment or have control of the same.
• When operating the equipment, comply with the provision of the Road Traffic Act 1974-1982 and its amendments (the Act) and regulations made under the provisions of the Act and shall only operate the equipment on made bitumen roads.
• Not damage the equipment and shall pay the Hire Operator, on demand, the cost of repair or replacement for any damage howsoever caused to the equipment.
• Indemnify the Hire Operator against any claims and costs whatsoever, arising out of use, operating, or keeping of the equipment or in any manner relating thereto.
• The Hirer declares and acknowledges that he/she hires the equipment at their own risk.
• The Hirer agrees that the Hire Operator accepts no responsibility for damage, including bodily injury, death, or any property damage or losses of any nature sustained by the Hirer or any person whatsoever and howsoever arising out of or incidental to the hire of the equipment or anything ancillary thereto, and the Hirer and his executors and administrators expressly renounces all claims against the Hire Operator or not.
• The Hirer shall take the equipment in the condition in which it was at the commencement of the hire, and the Hire Operator shall not be responsible for any defects in the equipment and does not warrant that the equipment is suitable for the particular or any purpose for which it is to be required. All conditions, warranties, and representations whether expressed or implied in favour of the Hirer are hereby excluded.
• The Hirer shall return the equipment to the Hire Operator within the time stipulated over the page, and should the equipment not be returned within the stipulated time, then the Bond or part thereof shall be forfeited.
• The Hirer shall pay forthwith any fines imposed pursuant to the Act or the regulations in respect of the equipment or the use of the equipment whilst it is in the control or custody of the Hirer during the continuance of the term of the hire.
• If the equipment breaks down during the term of the hire, the Hirer shall, at their expense, return the equipment to the Hire Operator, and the Hire Operator shall not be responsible for any expenditure, damage, and/or loss incurred by the Hirer arising out of any breakdown of the equipment howsoever caused. The Hire Operator will use its best endeavours to replace the equipment with similar equipment if available.
• The Hirer agrees that they will not use the bicycle after dark without the Hirer providing sufficient lighting as per the Act.
7. HEALTH AND FITNESS
• Participants must be in good physical health and capable of participating in the activities included in the tour, such as cycling and walking. We will not be held responsible for any injuries, health issues, or other medical conditions that may occur during the tour.
• If you suffer from severe muscular, chest, heart, sight, hearing, or bronchial disorders, or if you are a severe asthmatic, or have high blood pressure, you are strongly advised against participating.
• While we do not discriminate by age, please carefully consider your ability to participate in a 10km cycle tour. LTE reserves the right, in its absolute discretion, to refuse a participant the right to participate in a tour.
8. MEDICAL DISCLOSURE
You declare and warrant that:
• You are in good health and mental and physical fitness at the time of booking this tour.
• You have disclosed to LTE every matter concerning your health and mental and physical fitness of which you are aware that is relevant to LTE’s decision to permit you to go on the adventure tour.
• Immediately upon any adverse change in your health or fitness that may be likely to affect LTE’s decision to permit you to go on the adventure tour, you will
9. TOUR LEADER
• LTE tour guides and escorts take their responsibilities seriously, and if for any reason a tour leader or escort believes, in his or her absolute discretion, that you should not participate in the tour before your departure, he or she may exclude you from the tour. In this event, you will be offered the option of a full refund. If for any reason during a tour the tour leader or escort considers, in his or her sole discretion, that your behavior, fitness, or mental or physical health is likely to cause danger, distress, or annoyance to others, he or she may direct you not to continue, and you must follow the tour leader’s/escort’s instruction. In this case, you will not be entitled to any refund.
• LTE reserves the right to change, at any time, the tour leader or escort of any tour. If that happens, LTE will try to ensure that the alternative tour leader or escort has expertise commensurate with that of the original tour leader or escort. Any such change to LTE will not give rise to any right on your part to cancel the tour or claim any expenses, loss, or damage which may be suffered.
10. ROUTE CHANGES & ITINERARY
• LTE reserves the right to either before or during a tour:
• Cancel or modify any routes within the tour or objectives set out in the itinerary; or
• Substitute different or equivalent routes within the tour in place of canceled or modified routes.
• Itineraries and other details are published in good faith as statements of intention only, and reasonable changes in the itinerary and related items may be made where deemed necessary or advisable by LTE.
11. PRIVACY
• You permit LTE to collect personal information from you or from your medical practitioner regarding your health and medical condition. You acknowledge that this personal information may be disclosed to LTE representatives to ensure your safety and well-being but will not be used by them for any other purpose.
12. JURISDICTION
• It is a condition of booking that all parties agree that the transaction occurs in the Australian State of Western Australia and that the applicable laws of Western Australia shall apply.
• All parties unconditionally agree to submit any dispute in connection with the booking agreement to the jurisdiction of the Courts of Western Australia.
