Ningaloo Stars: Terms and Conditions Event: Ningaloo Stars – Astronomy Night Date: On-going, variable days. These Terms and Conditions govern your participation in events organised by Ningaloo Stars. By purchasing a ticket, you agree to comply with and be bound by these terms. 1. Booking and Payment 1.1 Tickets for Ningaloo Stars events must be purchased in advance through our website or authorised sales channels. 1.2 Payment must be made in full at the time of booking. 2. Cancellation and Refund Policy 2.1 Ningaloo Stars reserves the right to cancel stargazing nights due to adverse weather conditions or unforeseen circumstances. In such cases, customers will be offered the following options: – A full refund of the ticket price, or – An alternative date for the event, subject to availability. 2.2 Customers must notify Ningaloo Stars of their choice (refund or reschedule) through official contact methods within 24 hours of cancellation to ensure timely processing. 3. Participant Responsibilities 3.1 Participants are expected to treat staff and fellow attendees with respect. Disruptive or abusive behaviour towards other customers and Ningaloo Stars staff members will result in removal from the event without refund. 3.2 Participants must adhere to all safety guidelines communicated by Ningaloo Stars staff. 3.3 All children under the age of 15 must be accompanied by an adult. 3.4 Parents are responsible for the safety of their children. 4. Health and Safety. 4.1 Participants: – Acknowledge that stargazing events involve inherent risks, including but not limited to slipping, tripping, and wildlife encounters. – Are responsible for ensuring they are in suitable health to participate in the event. – Take responsibility for their own safety when driving to and from events. 4.2 Ningaloo Stars is committed to providing a safe and enjoyable environment for all participants. Therefore, all astronomy events hosted by Ningaloo Stars are strictly alcohol-free . 5. Photography and Media Release 5.1 By attending the event, participants grant Ningaloo Stars the right to capture photographs and/or video footage for promotional purposes. Participants who prefer not to be photographed must inform staff prior to the event. 5.2 Ningaloo Stars retains copyright permissions for all photographs taken with Ningaloo stars photographic equipment unless otherwise stated. 6. Liability Waiver 6.1 By participating in Ningaloo Stars events, I acknowledge and agree to the following: – I am aware that participating in stargazing events involves certain risks, including but not limited to slipping on uneven terrain, exposure to wildlife, and use of telescopes. – I voluntarily assume full responsibility for any injuries, losses, or damages that may occur as a result of my participation. – I hereby release, waive, and discharge Ningaloo Stars and its employees, agents, and representatives from any claims or liabilities arising from my participation in this event, unless due to the negligence or intentional misconduct of Ningaloo Stars or its representatives. – Additionally, this waiver includes any injury, loss, or damage caused by the negligence of the releasees. 7. Governing Law 7.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Western Australia. 8. Amendments to Terms 8.1 Ningaloo Stars reserves the right to amend these Terms and Conditions at any time. Changes will be posted on our website, and continued participation constitutes acceptance of the updated terms. Cancellation Policy If cancellation is required, you are required to notify us at least 24 hours prior to your booking time. Please note that cancellations made within 24 hours will incur a re-booking fee. If Ningaloo Stars is forced to cancel your tour due to weather conditions outside of our control, guests can choose one of the following options: 1. Rescheduling to an alternate night, subject to availability and forecasted conditions 2. A full refund, including any booking fees By purchasing a ticket, you acknowledge that you have read and understood the Terms and Conditions, including the liability waiver and cancellation policy, and you agree to abide by them.
